TatoPlus Terms and Conditions

Welcome to TatoPlus (“TatoPlus,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of the TatoPlus mobile application, website, and related services (collectively, the “Platform” or “Services”).

TatoPlus is a food delivery marketplace that connects customers with independent restaurants and independent delivery partners.

By accessing or using TatoPlus, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old to use the Services. By using TatoPlus, you represent and warrant that you meet this requirement.

2. Marketplace Role of TatoPlus

TatoPlus does not prepare, cook, store, or inspect food.
Restaurants are solely responsible for:

  • Food preparation

  • Ingredient quality

  • Food safety

  • Allergen disclosures

  • Compliance with health laws

Delivery partners are independent third parties, not employees of TatoPlus.

TatoPlus acts solely as a technology platform facilitating orders and payments.

3. User Accounts

To use certain features, you must create an account.

You agree to:

  • Provide accurate and complete information

  • Keep your login credentials secure

  • Accept responsibility for all activity under your account

We may suspend or terminate accounts for violations or suspected fraud.

4. Placing Orders

When you place an order:

  • You authorize TatoPlus to place the order with the restaurant on your behalf

  • Prices, menus, and availability are set by the restaurant

  • Once accepted, orders may not be canceled or refunded, except as required by law or stated in our policies

Restaurants may substitute items or cancel orders due to availability.

5. Pricing, Fees, and Payment

Prices may include:

  • Food prices set by restaurants

  • Delivery fees

  • Service fees

  • Taxes and other applicable charges

All payments are processed electronically in U.S. Dollars (USD).

By placing an order, you authorize TatoPlus to charge your selected payment method.

Fees are non-refundable, except where required by law.

6. Delivery

Delivery times are estimates only and not guaranteed.

You acknowledge:

  • Delays may occur due to traffic, weather, or restaurant preparation

  • Delivery partners may leave orders at a safe location if you are unavailable

  • Risk of loss transfers to you upon delivery

7. Alcohol Orders (If Applicable)

If alcohol delivery is available:

  • You must be 21 years or older

  • Valid government-issued photo ID is required at delivery

  • Delivery partners may refuse delivery if ID is invalid or you appear intoxicated

8. Food Safety & Allergens

TatoPlus does not guarantee food quality, safety, or allergen-free preparation.

You are responsible for:

  • Reviewing ingredient and allergen information

  • Contacting restaurants with specific dietary concerns

Use of the Services is at your own risk.

9. User Conduct

You agree not to:

  • Abuse or harass delivery partners or restaurant staff

  • Submit false claims or fraudulent refund requests

  • Use the Platform for unlawful purposes

  • Interfere with Platform operations

Violations may result in account suspension or termination.

10. User Content

You may submit reviews, ratings, or other content (“User Content”).

By submitting User Content, you grant TatoPlus a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content.

We reserve the right to remove content at our discretion.

11. Independent Contractors

Delivery partners are independent contractors, not employees, agents, or joint venturers of TatoPlus.

TatoPlus does not control:

  • Delivery routes

  • Work hours

  • Acceptance or rejection of delivery requests

12. Promotions & Credits

Promotional offers and credits:

  • Have no cash value

  • May expire

  • May be revoked for misuse or fraud

13. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TATOPLUS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TATOPLUS SHALL NOT BE LIABLE FOR:

  • Food quality or safety issues

  • Allergic reactions

  • Delayed or incorrect orders

  • Acts or omissions of restaurants or delivery partners

TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PREVIOUS 12 MONTHS, OR $100, WHICHEVER IS GREATER.

15. Indemnification

You agree to indemnify and hold harmless TatoPlus from any claims arising out of:

  • Your use of the Services

  • Your violation of these Terms

  • Your interactions with restaurants or delivery partners

16. Termination

We may suspend or terminate your access at any time for any violation of these Terms.

17. Governing Law

These Terms are governed by the laws of the State of [Insert State, e.g., California or Delaware], without regard to conflict of law principles.

18. Dispute Resolution & Arbitration

Any dispute shall be resolved through binding arbitration, except where prohibited by law.

You waive the right to participate in class actions or class arbitration, to the extent permitted by law.

19. Changes to Terms

We may update these Terms at any time. Continued use of TatoPlus after changes constitutes acceptance.
